Trump's former lawyer steps down following court deems ineligible her appointment.
Alina Habba has stepped down as the US Attorney for New Jersey. This follows a court battle that challenged her eligibility to hold the office.
Attorney General's Statement
The head of the Justice Department, the Attorney General, accepted her stepping down on Monday. In a statement that the court's "flawed" ruling made it unworkable for her to effectively run her office.
"But do not mistake compliance for surrender," Habba stated. "This battle will now reach across the nation."
Legal Background
The departure was triggered by a federal appellate panel ruled that she had been serving in violation of the law as the top prosecutor. This ruling is likely to affect many legal proceedings in New Jersey.
The appellate judges declared that a interim role that did not receive the advice and consent of the Senate breached the federal law governing appointments.
Ongoing Legal Battle
Bondi said that she will stay on at the DOJ as a senior adviser. They intend to seek further review of the ruling, aiming for a different outcome.
On a social media platform, the Attorney General argued that the court "must not second-guess the appointment of lawyers tasked with carrying out the executive branch's core responsibility of criminal prosecution."
Performance in Office
The attorney general highlighted the prosecutor's work and said that while she was in charge, the city of Newark saw a significant drop in crime. Additionally that the Camden had its first summer in half a century free from homicides.
Legal Career
The 41-year-old attorney, was initially recruited to the former president's legal defense in 2021. She later defended the former president in his business records case in the previous year, when he was conviction on multiple felony counts of financial record manipulation.
Earlier, her appointment to the role of US Attorney, Donald Trump had revealed he was selecting her as his White House advisor if re-elected, calling her as deeply loyal and a dedicated fighter for justice.
